When you register with 'theClassified' you agree to the following additional Terms and Conditions.

Age: 'theClassified' is for the use of person who are over 18 and are able to undertake legally binding sale or purchase transactions. If you are under 18, you may still use the site only in conjunction with, and under the supervision of, a parent or legal guardian who is themselves over 18 years of age. As such, the adult is the responsible party for all activity that the minor undertakes.

Password: We ask that you keep your password secure at all times. If you fail to keep your password secure, you remain fully responsible for all activity undertaken on the site, and will be liable for any damage/abuse that is caused. Should you become aware that your password may have been compromised, you should contact 'theClassified' as soon as possible so that corrective action may be undertaken. You will, however, indemnify 'theClassified' for any loss or damage.

Account Information: You will keep your account information up to date at all times, in particular a valid email address by which you can be contacted.

Compliance: You agree to be bound by all local laws and taxes, as well as all Terms and Conditions that exist currently.

Usage of Data: Registration to 'theClassified' is free and in return we may occasionally contact you to promote our sites and businesses. You accept that we may contact you, but you are under no obligation to act upon, or reply, to such communication.

Registering with 'theClassified' is free and fees only become payable when you want to advertise:

• Individual adverts may be placed on 'theClassified' based on fixed fees related to the duration of the advert being placed. You should refer to the latest pricing information that is published within the site.
• Subscriptions/storefronts may also be purchased based on the type of selling you want to undertake. You are under no obligation to renew your subscription.

With each subscription you may advertise as many products/services as you like (subject to a reasonable usage policy). You can add, change and remove as often as you like within the duration of your subscription. Facility does exist to cease your subscription and renew again at a later date - while some content may be retained by the site, 'theClassified' does reserve the right to remove content within its housekeeping processes.

'theClassified' takes no percentage of any fees that result from a successful sale.

You may terminate your account at any time, but you will not be entitled to any refunds for remaining duration of your service. There are no additional fees for closing an account.

All fees are liable to VAT at the prevailing UK rate. VAT invoices will be available as required for the reclaim of taxes paid if due, but any such claim is solely your responsibility.

When you decide to advertise, be it on an individual basis or as the owner of a storefront via subscription, you agree to do so responsibly:

Description: You will fully and accurately describe the item, including any flaws or defects that buyers may need to be aware of. You will also make sure that the item has been correctly categorised within the'theClassified' structure of works for sale. You will not try to mislead or create false impression of the product/service.

Ownership: You warrant that you are legally entitled to sell the item and where necessary can provide appropriate supporting documentation such as a bill of sale. Other forms of proof of ownership may be required by buyers and you will be prepared to answer such requests in a timely manner.

Conditions of Sale: Should you have any particular conditions of sale e.g. regarding shipping; method of payment etc, then these should be included as descriptive notes within your advert.

Binding Sales: Should you agree to sell your item, subject to your or our terms and conditions, you must complete the transaction. As seller, you are obligated to ship the item, unless there are exceptional circumstances. Buyers are obligated to ensure payment is received by the seller.

Abuse: You should not advertise items that abuse 'theClassified' terms and conditions and that are, or may be construed as:

• false or misleading
• fraudulent, illegal or counterfeit
• infringe on someone else's copyright, trademarks, trade secrets or other intellectual property rights
• discriminatory; defamatory; libellous; threatening; plagiarised; obscene; child pornography
• hidden code likely to cause harm to computer systems and networks
• appear to create an impression of ownership; corroboration; sponsorship or endorsement by 'theClassified'
• a violation of these terms and conditions

License: By advertising your items you do not confer any ownership rights to 'theClassified' but you do license them to promote and advertise your items, royalty free, though the website. This will inevitably result in search engines analysing and indexing your content, and in turn the creation, by parties unknown, of links to, and placement on, other websites and you acknowledge that this is outside the control of 'theClassified'.

Privacy: As an advertiser you are likely to become aware of personal information of potential buyers and site visitors. You will treat this data with appropriate discretion and subject to local laws regarding data protection and privacy. In particular, you will not use this information for any purpose other than the transaction that brought its content to your knowledge, and will not share with any 3rd parties.

'theClassified' and its licensees and users aims to provide a safe experience. Please report problems, offensive content and policy breaches to 'theClassified' by using the contact details on the 'Contact Us' page.

Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off 'theClassified' if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, which ever remedies 'theClassified' do or do not decide to impose, 'theClassified' do not accept any liability for monitoring 'theClassified' for unauthorized or unlawful content, or usage.

Should you have a dispute with 'theClassified' you should first check these Terms and Conditions for any indication of resolution or guidance. You should then email admin@illuceo.com providing the details of the dispute including timelines; persons involved; correspondence etc. The more evidence provided, the quicker may a dispute be resolved.

Should a dispute arise between visitors and users of the site, you release 'theClassified' from any and all claims, demands and damages (actual and consequential) of every kind and nature arising out of the dispute.

'theClassified' may entirely at its discretion try to assist in matters of dispute, but is under no obligation to do so. Should 'theClassified' attempt to mediate in a dispute, it does so in good faith only and cannot be held accountable for any outcomes, especially where further dispute arises.

Ultimately disputes will be resolved by Governing Law - see below.

'theClassified' is a network of sites across the UK. Some of 'theClassified' features may now, or in the future, allow ads to be shared across this network. By using 'theClassified' you place no restrictions on your ads appearing on sister sites. The Terms and Conditions for all of our sites are consistent, and therefore you are bound by them wherever your ad is placed or used.

By using 'theClassified' you agree to the collection, storage and usage of your personal information on databases hosted in the United States and the United Kingdom.

These terms are governed by the laws of England & Wales, whose courts shall have sole jurisdiction in relation to all matters arising.
